WARRANTY
Eco-Lite Products, LLC and Eco-Lite, LLC (both hereinafter “Eco-Lite”) warrants to the original purchaser of our LED products a “5 year limited warranty” on all LED overhead fixtures, LED PAR, MR and BR lamps and a “3 year limited warranty” on all LED linear fixtures (hereinafter described as “product(s)” or “fixture(s)”) that they will be free from material defects in material and workmanship for a period of five (5) years or three (3) from the date of shipment by Eco-Lite or, if lesser, 25,000 hours of operation on overhead fixtures (5 year warranty) and 15,000 hours on linear fixtures (3 year warranty). The date of shipment shall be the date products ordered have been shipped to the customer.
The above express limited warranty is extended by Eco-Lite only to the original purchaser and only for the originally installed location. Any LED product moved or removed and reinstalled from its original location will not be subject to the Eco-Lite warranty. This warranty is non-transferrable, whether by assignment or operation of law. The original purchaser must provide warranty claims to Eco-Lite within the warranty period promptly upon discovery and in accordance with Eco-Lite’s Return and Repair Procedures as outlined within this document.
Should any defects be found by Eco-Lite® upon its inspection of the properly returned product, the sole responsibility and liability of Eco-Lite under this warranty will be, at its option, to either repair or replace the defective product or fixture or else make available a new replacement unit that will provide equal or better performance subject to the limitations set forth below. All decisions regarding the existence or non-existence of defects or otherwise affecting the warranty shall be made by Eco-Lite and shall be final and binding on all parties. Where a defective LED product is replaced under this warranty, the balance of the original warranty period shall remain effective and shall not be extended.
Conditions and Exclusions
This warranty is conditioned upon proper installation, use and maintenance of the products or fixtures. This warranty shall automatically become null and void and shall not be applicable to any LED fixture or product which (i) has not been timely paid for, (ii) is not installed and operated in accordance with the current edition of The National Electric Code (NEC), the Standards for Safety of Underwriters’ Laboratory, Inc. (UL) or with Eco-Lite’s instructions and guidelines, (iii) has been moved from its original installation, (iv) has been installed within an area that has exposure to sulfur or any area with high acidic compounds in use, (v) has been operated in an ambient temperature or humidity that is higher than 35 degrees Celsius, (vi) has been subjected to a lightning strike, power surge, voltage fluctuation or overvoltage condition, (vii) has the LED components contained in its products or fixtures subjected to static electricity due to failure to discharge same prior to connecting or disconnecting the LED products or fixtures, (viii) was not installed and/or operated in accordance with Eco-Lite’s instructions and guidelines, (ix) has been mishandled, misused, abused, tampered with, modified or altered by anyone other than Eco-Lite (x) has been subjected to abnormal stresses and operating conditions, or (xi) has been operated without overvoltage, voltage fluctuation and lightning protection devices in place.
Limitations
Complete fixtures, whether overhead or linear will need to be removed and returned back to Eco-Lite for evaluation in accordance with Eco-Lite’s Return and Repair Policy and Procedures as set forth below. Any products or fixtures which Eco-Lite has determined to be covered by this warranty will be repaired or replaced in accordance with this warranty document at no cost to purchaser. Purchaser will be responsible for all shipping costs. If a returned fixture or product is determined by Eco-Lite not to be eligible for coverage under its warranty the customer will be notified of the costs, including labor and related costs and expenses, to repair the returned product or fixture and the customer has the option of choosing to have the product or fixture repaired or to pay for the product or fixture to be returned to them.
Disclaimers & Limitations of Liability
The foregoing warranty is exclusive of all other warranties whether they be statutory, written or oral and no other warranties of any kind or nature, statutory, by operation of law or course of performance, or otherwise, are given, herein expressed or otherwise received. EXCEPT AS EXPRESSLY PROVIDED ABOVE, ECO-LITE DISCLAIMS ALL REPRESENTATIONS, WARRANTIES AND CONDITIONS OF ANY KIND, EXPRESS OR IMPLIED, REGARDING THE LED PRODUCTS AND ITS SERVICES, INCLUDING, WITHOUT LIMITATION, THE IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR USE OR PURPOSE.
LIMITATION OF LIABILITY. Other than the obligation to repair or replace as provided above, Eco-Lite shall have no liability for any losses, expenses or damages as a result of the installation, use, inability to use, removal or replacement of any LED product or fixture. Eco-Lite shall not under any circumstances whether as a result of breach of contract, breach of warranty, tort, strict liability or otherwise be liable for consequential, incidental, special or exemplary damages including but not limited to, loss of profits or revenues, loss of any other goods or associated equipment or damage to any associated equipment, cost of capital, cost of substitute products, facilities or services, down time cost or claims of claimant’s customers. Eco-Lite’s liability on any claim of any kind for any loss or damages arising out of, resulting from or concerning any LED product or fixture, any aspect of this warranty or for any products or services furnished hereunder shall not exceed the price of the fixture or product which gives rise to the claim.
From time to time there are changes and modifications in the design, look and function of a product and fixture. From time to time products and fixtures are discontinued. If any product or fixture that is subject to replacement is no longer available Eco-Lite’s sole responsibility and liability shall be to use its best efforts to supply a product that, at Eco-Lite’s sole discretions, is similar in design and function. Under no circumstances shall Eco-Lite be responsible to replace any fixtures or products to match the look, style and function of the originally shipped fixtures and products.
Return and Repair Procedures
Any and all warranty requests and or questions are to be directed to Eco-Lite at 845-365-9770. If a product is subject to the Eco-Lite warranty, Eco-Lite will issue a Return Merchandise Authorization (RMA) number which must be included on both the packing slip of the product or fixture being returned and VISIBLY on the outside of the box. All returns must include the customer’s name and contact information, including phone numbers and a valid email address and the issue you are having with the product on the packing slip so that we are able to diagnose the problem and easily get in touch with you. Each product or fixture being returned must be packaged in such a way as to prevent damage in shipment and must be shipped freight prepaid.
Once the product or fixture has been received and tested, Eco-Lite will contact you, and notify you if the product or fixture is covered under the warranty policy and will either be repaired or replaced or the product or fixture is not covered under the warranty policy and the reason for this determination.
If Eco-Lite determines that the product or fixture is covered under the warranty, then the appropriate repairs will be started or a replacement fixture will be manufactured and shipped as soon as practical with the understanding that there are at times delays in receiving components necessary to repair and/or replace a product or fixture. In the event it is determined that a returned product or fixture is not to be covered under this warranty, you will be responsible for all return shipping charges and fees which have been paid for by Eco-Lite.

No Labor Reimbursement
All products and fixtures determined to be covered by this warranty as provided above, will be repaired or replaced at no charge to the customer. Eco-Lite shall not be responsible for any costs associated with the removal, return or installation of a repaired or replaced product or fixture. The customer is solely responsible to hire and pay for an electrician to remove and reinstall such products and fixtures. No labor costs will be covered for the removal or reinstallation of any products or fixtures. The warranty does not cover modifications, repairs or replacements, or the related labor or materials costs, that may be necessary to facilities or third party products in connection with the removal, repair, or replacement of any LED product under this warranty.
Additional Limitations of Liability
1. Normal wear and tear on the fixture is not covered by this warranty. Exterior or mechanical damage that is not due to a warranty defect will not be corrected. No cosmetic repairs will be made.
2. The above is the only warranty made by Eco-Lite. No dealer, distributor, or any other person or entity is authorized to make any representation, warranty or promise on behalf of Eco-Lite concerning its warranty.
3. In the event that Eco-Lite has supplied a product or fixture that was manufactured by a company, distributor or dealer other than Eco-Lite the warranty associated with that companies product or fixture shall govern and be applicable to all warranty claims.
4. Under no circumstances shall the above warranty on these LED products or fixtures exceed the lesser of five (5) years or 25,000 hours of operation or three (3) years and 15,000 hours of operation.
